Bookmate Terms and Conditions – Peer-to-Peer Carpark Marketplace

Effective Date: July 4, 2025

These Terms and Conditions (“Terms”) form a legally binding agreement between you (“you,” “your,” or “user”) and Bookmate Limited (“Bookmate,” “we,” “us,” or “our”) governing your use of the Bookmate website, mobile application, and related services (collectively, the “Bookmate Services”).

  1. Definitions

Host: A user who lists a carpark space for rent on the Bookmate platform.

Parker: A user who books a carpark space listed by a Host.

Marketplace: The Bookmate platform facilitating transactions between Hosts and Parkers.

Service Provider: Third-party companies involved in payment processing, marketing, or other services related to Bookmate.

  1. Acceptance and Updates

2.1 Acceptance of Terms

By registering for or using Bookmate Services, you agree to comply with and be bound by these Terms. If you do not agree, please do not use the platform.

2.2 Updates to Terms

We may update these Terms at any time. Updated Terms will be posted on our website and app. Continued use of Bookmate Services after updates constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically.

  1. Account Registration and Management

3.1 Registration

Registration is free and requires you to provide accurate, complete, and current information, including your name, email address, and vehicle or property details depending on your role.

You may not create an account on behalf of another person or impersonate any individual or entity.

You must comply with all applicable local laws, safety requirements, and property rules related to any carpark spaces listed or booked.

3.2 Account Security

You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.

Notify us immediately at support@bookmate.co.nz if you suspect unauthorized use or breach of your account.

You must not share your password or allow others to access your account.

3.3 Account Information Updates

Keep your personal, contact, and payment information accurate and up to date.

Failure to do so may result in cancellation of bookings or removal of listings.

3.4 Account Closure

You may request to close your account by contacting support@bookmate.co.nz.

Bookmate may retain certain information after account closure to comply with legal obligations.

You may request a copy of your retained personal data.

  1. Marketplace Rules and User Conduct

4.1 User Obligations

You agree to use Bookmate Services lawfully and ethically.

You must not post misleading, fraudulent, illegal, or offensive content.

You may not use the platform for any unlawful or abusive activities.

Circumventing Bookmate’s payment systems or engaging in transactions outside the platform is prohibited.

Harassment, threats, or abuse of other users is forbidden.

4.2 Content Removal and Suspension

Bookmate reserves the right to remove any content or suspend user accounts at its sole discretion for violations of these Terms.

  1. Listing and Booking Carpark Spaces

5.1 Host Responsibilities

Hosts must provide accurate, truthful, and complete information about their carpark spaces, including availability, location, and pricing.

Hosts confirm they have the legal right and authority to rent out the listed space.

Hosts must ensure their spaces comply with all relevant laws, regulations, and property rules.

5.2 Parker Responsibilities

Parkers must verify the suitability and location of the carpark space before booking.

Parkers agree to use the space in accordance with the terms set by the Host and any applicable laws.

5.3 Role of Bookmate

Bookmate acts solely as a marketplace facilitator connecting Hosts and Parkers.

Bookmate is not a party to any rental agreement between Hosts and Parkers and disclaims liability arising from such agreements.

  1. Fees, Payments, and Refunds

6.1 Fees and Payment Processing

Booking fees include the Host’s listed price plus any applicable service fees, all in New Zealand Dollars (NZD) including GST if applicable.

Payments are securely processed through third-party providers (e.g., Stripe).

By using Bookmate, you authorize us to charge your nominated payment method.

Prices and fees may be updated periodically without prior notice.

6.2 Refunds

Refunds may be granted in the following cases:

System errors causing incorrect charges.

Duplicate payments.

Overpayments.

Cancelled or failed transactions where payment was processed.

Unauthorized charges, subject to investigation.

Refunds are generally not granted for:

Change of mind after booking.

Incorrect booking duration or selection not corrected before payment.

Completed leases.

Breaches of these Terms resulting in penalties or complaints.

6.3 Refund Requests

Submit refund requests via the online form including:

Full name and contact details.

Vehicle license plate.

Requested refund amount.

Reason for refund.

Transaction date.

Supporting evidence (screenshots, receipts, error messages).

Bookmate aims to respond within 5 business days.

Approved refunds are processed via the original payment method or as Bookmate credit for user errors.

A 1.75% surcharge may apply to credit/debit card refunds.

If declined, you may escalate to Bookmate support or relevant consumer protection authorities.

  1. Insurance and Liability

7.1 Insurance Obligations

Hosts must ensure their carpark spaces are covered by appropriate insurance, including third-party liability and property damage during rental periods.

Parkers are responsible for maintaining valid insurance on their vehicles.

Bookmate may request proof of insurance from Hosts.

7.2 Liability Limitations

Bookmate is not liable for any damage, loss, or injury arising from the use of the platform or carpark spaces, except as required by law.

Hosts and Parkers agree to indemnify Bookmate against claims arising from their use or misuse of the platform.

  1. Dispute Resolution

Users should attempt to resolve disputes directly with each other.

If unresolved, disputes may be escalated to Bookmate support.

If still unresolved, users may pursue resolution through the New Zealand Disputes Tribunal or other relevant authorities.

  1. Privacy and Data Use

9.1 Privacy Policy

Your use of Bookmate is subject to our Privacy Policy, which explains how we collect, use, and disclose your personal information. The policy is available at [Privacy Policy Link].

9.2 Data Collection

We collect personal information including name, contact details, vehicle and payment information.

We automatically collect usage data, booking history, device information, IP address, and location data.

We may use cookies and similar technologies to enhance your experience.

9.3 Third-Party Data

We may obtain information from third parties (payment processors, marketing agencies, social media) to verify or supplement your data.

9.4 Use and Sharing of Data

Your data is used to provide and improve Bookmate Services, communicate with you, conduct analytics, and for marketing.

Anonymized or aggregated data may be shared with investors or buyers.

Your data may be shared with contractors and affiliates who comply with our Privacy Policy.

You may request assistance if you believe your data is incorrect.

  1. Security

You are responsible for keeping your login credentials confidential.

Bookmate implements reasonable security measures but cannot guarantee absolute security.

Payments are processed by PCI DSS Level 1 compliant providers; Bookmate does not store your credit card information.

  1. Intellectual Property

Bookmate and its licensors own all intellectual property rights in the platform, including software, text, images, logos, and graphics.

You may not copy, adapt, distribute, or commercialize any content without prior written permission.

  1. Termination and Blocking

Bookmate may suspend, block, or terminate your access without notice if you breach these Terms.

We reserve the right to block users at our sole discretion.

  1. Disclaimers

Use of Bookmate is at your own risk.

Bookmate does not guarantee protection against fraud, unauthorized access, or cyber risks.

We are not liable for service interruptions due to network or third-party failures.

Bookmate is not responsible for disputes or issues between Hosts and Parkers.

  1. Limitation of Liability and Indemnity

Bookmate aims to provide uninterrupted service but does not guarantee it.

Except as required by law, Bookmate excludes liability for any direct or indirect losses.

You agree to indemnify Bookmate for claims arising from your breach of these Terms or misuse of the platform.

These Terms represent a fair allocation of risk necessary to protect Bookmate’s business.

  1. Prohibited Activities

You agree not to:

Use the platform for illegal or unauthorized purposes.

Attempt to bypass Bookmate’s payment or fee structures.

List spaces you do not own or have authority to rent.

Engage in discriminatory, unsafe, or fraudulent behavior.

  1. General Provisions

16.1 Force Majeure

Bookmate is not liable for failure or delay caused by events beyond its control (natural disasters, technical failures, government actions).

16.2 Consumer Guarantees Act

These Terms do not override your rights under the Consumer Guarantees Act 1993 unless you use Bookmate for business purposes, in which case the Act is contracted out to the extent permitted by law.

16.3 No Waiver

Failure to enforce any provision does not waive Bookmate’s right to enforce it later.

16.4 Governing Law and Jurisdiction

These Terms are governed by New Zealand law. You agree to submit to the non-exclusive jurisdiction of New Zealand courts.
